Living Wills are an important step in respecting people’s autonomy and ensuring their wishes are honoured. However, they are distinct from the issue of Assisted Voluntary Euthanasia.![]()
It is also important to clarify that the powers of a Living Will are not limited to those who are terminally ill. Everyone should have the right to make decisions about their future care in any medical situation where they are unable to communicate.
We look forward to continued, evidence-based discussion on how best to uphold dignity, autonomy, and compassion in healthcare.![]()

⚖️ The proposed Living Wills legislation represents an important step forward for personal autonomy and dignity.![]()
📜 Legally-enforceable Living Wills (or Advance Directives) allow individuals to clearly state in advance which medical treatments they consent to or refuse if they are no longer able to communicate their wishes. This helps ensure that a person’s values and wishes remain respected, even in the most difficult circumstances.![]()
🧭 From a humanist perspective, the principle is clear: every competent adult has the right to make informed decisions about their own body and medical care. Respect for autonomy, compassion for those facing difficult choices, and trust in human judgement are central humanist values.![]()
🤝 Living Wills help safeguard these principles while also providing clarity and reassurance for families and healthcare professionals.![]()
🇲🇹 While we await full details of the bill, we welcome this progress on proposals we first made in 2022, and encourage continued thoughtful discussion on how Malta can further strengthen dignity, compassion, and individual choice.![]()

The Government is now returning to a subject - on which no progress had been made since 2020 - with forthcoming proposals for legislation including the establishment of a Human Rights and Equality Commission in line with EU law. The meeting with our Chair, James Buħagiar, and Vice-Chair, Christian Colombo, was positive and constructive. We look forward to seeing the draft of the proposed legislation.![]()
